A Canadian work permit allows foreign nationals to work legally in Canada for a specific employer or on an open basis. Whether you're coming temporarily for employment or transitioning from student life, Canada offers several types of work permits based on your situation.
a. Labour Market Impact Assessment (LMIA)
An LMIA-based work permit is issued when a Canadian employer receives approval from Employment and Social Development Canada (ESDC) to hire a foreign worker.
The employer must prove no Canadian was available for the role
A positive LMIA strengthens the foreign worker’s work permit application
LMIA jobs can lead to permanent residency under certain immigration programs
b. Post-Graduation Work Permit (PGWP)
The PGWP is an open work permit for international students who have graduated from an eligible Canadian post-secondary institution .
Valid for up to 3 years , depending on the length of your study program
No job offer required to apply
Gaining Canadian work experience on a PGWP helps qualify for permanent residency programs like Express Entry or CEC
c. Spousal Open Work Permit (SOWP)
A Spousal Open Work Permit (SOWP) allows the spouse or common-law partner of a skilled foreign worker or international student in Canada to work for any employer across the country. This permit provides flexibility and support for families, enabling spouses to contribute to the household income and gain valuable Canadian work experience.
Who Is Eligible?
As of January 21, 2025, eligibility for a SOWP is limited to spouses of:
International Students enrolled in:
Master’s programs of 16 months or longer .
Doctoral programs.
Select professional or eligible programs.
Foreign Workers employed in:
TEER 0 or 1 occupations (management or professional roles).
Certain TEER 2 or 3 occupations in sectors experiencing labor shortages or aligned with government priorities, such as:
Natural and applied sciences
Construction
Healthcare
Natural resources
Education
Sports and military sectors
The foreign worker’s employment must be supported by a valid work permit or a work permit approval letter, with at least 16 months remaining at the time of the spouse’s application .
Note: Dependent children of foreign workers are no longer eligible for open work permits under these new rules.
